The High Court sitting in Ota, Ogun State, has rendered its verdict, ruling in favor of Pastor Larry Omodia of African Television in the case against Joseph Aloba, aka Baba Mohbad.
Baba Mohbad had submitted an injunction against African Television, thereby preventing the planned concert in honor of the late singer Ilerioluwa Promise Aloba, also known as Mohbad.
On September 12, 2024, Baba Mohbad accused African TV of using his deceased son's name for monetary purposes and obstructing his ability to grieve following Mohbad's death.
As a result of the court injunction, African TV cancelled its scheduled program and attended court, while Baba Mohbad did not appear. In response to Baba Mohbad's filing, African TV responded and upon receiving his response, Baba Mohbad chickened out to withdraw the case.
During yesterday's court proceedings, the judge highlighted errors committed by Baba Mohbad's legal representative, Odumosu, in filing an affidavit against the complainant. Following extensive debate on withdrawing the case, African TV's legal team countered that dismissal was more appropriate due to lack of merit.
The judge ultimately dismissed the case, awarding African TV N50,000, a fraction of the N500,000 requested by their legal counsel for appearance fees and compensation for time wasted. African Television was thereby cleared to move forward with the concert.
In a post-verdict statement, African Television conveyed its delight at his win, announcing plans to file a lawsuit against Baba Mohbad, claiming three million naira damages. He added that his win is a sign that justice must prevail.
